Police Led Presentation Officer Leamington Spa, Warwickshire Permanent Full Time x 1 Part Time (18.5) x 1 The closing date for this post is 12 noon on 17th December 2019 Those currently eligible on the redeployment register will be given prior consideration. Interviews dates to be confirmed The main purpose of the role is to attend Magistrates courts in Warwickshire, presenting evidence in Specified Offence Proceedings. To attend Magistrates Courts in Warwickshire to present evidence in relation to summary trials Main Responsibilities: To receive all Specified Offence or summary prosecution files for presentation at Court. Check file for correct evidence and sufficiency to proceed at court. Identify any additional requirements or remedial input and take appropriate action. To ensure the right person is prosecuted for the right offence and always act in the interests of justice considering that in certain circumstances other methods of disposal may be suitable as an alternative to prosecution. To identify those documents to be disclosed to the defendant in respect of MCA and summary cases, in order to ensure that all administration can be completed and cases are dealt with expeditiously at court, avoiding adjournments. To identify those documents to be disclosed in respect of Non-MCA cases, where appropriate, for the purposes of providing Advanced Information to Defence, Probation, Courts, CPS and Police Witness Care Units in order to ensure best use of court time and any witness care issues can be addressed by all agencies. To liaise with the Crown Prosecution Service for any reason where it is considered that appropriate legal advice should be sought before proceeding further. To liaise with other prosecution agencies e.g. the Department of Vehicle Licensing, H.M. Custom and Excise and telephone queries from defendants where necessary and to resolve queries. To update NSPIS Case database application with all appropriate actions, including decision made, in order to ensure that progress is logged and information is Police Led accurate, up to date and easily accessible to others. To deal with any correspondence from the public, Solicitors and partner agencies, ensuring that necessary action is initiated and that appropriate responses are sent in a timely manner. To attend court and deal with any preparatory work to avoid cases taking up unnecessary court time. To present cases at Court, requesting appropriate adjournments for trials or further hearings when required. To undertake other duties commensurate with the nature, level of responsibility and grading of this post, as required. Experience/Skills: Knowledge: Educated to 'A' level standard, or equivalent. Knowledge of criminal and traffic law Conversant with the Charging Standards 5th edition, National File Standards, Manual of Guidance and Code for Crown Prosecutors. Experience: Significant experience of working in a Criminal Justice environment, particularly with regard to:- The application of Traffic Law Evidential rules applicable to summary prosecution files. Application of Code for Crown Prosecutors Key Skills: Must be able to justify legal arguments with evidence and to present cases at court. Must be able to provide advice and guidance and influence at all levels. Must be able to make decisions based on sound judgement and rationale. Must be able to work on own initiative, prioritise and be responsible for own workload Special Conditions Travel throughout Warwickshire The post holder will be required to successfully achieve accreditation at Assistant Prosecutor level within 12 months if this qualification is not already held.
